1. About ChiroMarket

ChiroMarket is an AI-powered marketing tool designed exclusively for chiropractic practices. It generates marketing content including Google Ads, Facebook and Instagram ads, email copy, and landing pages. ChiroMarket is not a clinical records system, electronic health records (EHR) platform, or patient management system.

2. Not a HIPAA-Covered Platform

ChiroMarket is a marketing tool and is not intended to store, transmit, or process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). Specifically:

• ChiroMarket does not store patient medical records, diagnoses, treatment notes, insurance information, or any clinical data.
• Lead information captured through ChiroMarket landing pages (name, phone, email) represents prospective patients who have voluntarily submitted a marketing inquiry — this is standard marketing data, not PHI.
• ChiroMarket does not offer, and you should not rely on ChiroMarket as a Business Associate (as defined under HIPAA).
• You are solely responsible for ensuring that any information you enter into ChiroMarket does not constitute PHI. Do not enter patient medical records, diagnoses, or treatment information into ChiroMarket.

3. Acceptable Use

By using ChiroMarket, you agree to use it solely for lawful marketing purposes. You agree not to:

• Enter, upload, or transmit any Protected Health Information (PHI) into the platform.
• Use ChiroMarket to manage patient clinical records or treatment information.
• Use ChiroMarket in any way that violates applicable federal, state, or local laws.
• Attempt to reverse-engineer, copy, or redistribute ChiroMarket's AI models, prompts, or proprietary content.

4. Your Data

Your practice information and marketing data are stored securely and restricted to your account only. We do not sell, rent, or share your data with third parties. All data is encrypted in transit (TLS 1.3) and at rest (AES-256). You retain ownership of all content you create using ChiroMarket.

5. AI-Generated Content

ChiroMarket uses artificial intelligence to generate marketing content. AI-generated content is provided as a starting point and may require review and editing before use. You are responsible for reviewing all generated content for accuracy, compliance with advertising regulations, and suitability for your practice before publishing or distributing it.

6. Subscriptions and Billing

ChiroMarket offers monthly and annual subscription plans. Subscriptions begin with a 7-day free trial. You may cancel at any time. Cancellations take effect at the end of the current billing period. Refunds are not provided for partial billing periods. All payments are processed securely through Stripe.

7. Limitation of Liability

ChiroMarket is provided "as is" without warranties of any kind. We are not liable for the performance of any advertising campaigns run using ChiroMarket-generated content, for any regulatory compliance issues arising from your use of generated content, or for any indirect, incidental, or consequential damages.

8. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of ChiroMarket after changes are posted constitutes your acceptance of the updated terms.
